Platform Role & Exemption

SpinBox s.r.o. operates as an online platform that allows users to upload and share user-generated content. Slaybox does not produce any of the visual depictions of actual or simulated sexually explicit conduct that appear on the platform.

As a hosting platform for user-generated content, Slaybox qualifies for the secondary producer exemption under 18 U.S.C. § 2257(h)(2)(B)(v) and is not required to maintain the records specified in 18 U.S.C. § 2257(a) for content uploaded by users.

Primary Producer Responsibility

Each creator who uploads content to Slaybox is considered the primary producer of their own content under 18 U.S.C. § 2257. As such, creators are solely responsible for:

• Age Verification: Verifying the age of all individuals depicted in their content and confirming all performers are at least 18 years of age at the time of production
• Record Creation: Creating and maintaining all records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75
• Identification Documents: Obtaining and retaining copies of valid government-issued photo identification for all performers
• Cross-Reference Index: Maintaining an index cross-referencing each performer's stage name or other identifier to their legal name and records
• Record Retention: Retaining all required records for a minimum of seven (7) years from the date of creation or last publication of the content
• Inspection Availability: Making records available for inspection by the Attorney General as required by law

Custodian of Records

For content uploaded by creators, the creator is the custodian of records for their own content. Creators must designate a custodian of records and maintain accurate contact information as required by law.

Creator Compliance Requirements

By uploading content to Slaybox, creators certify and warrant that:

• All individuals depicted in their content were at least 18 years of age at the time of production
• They have obtained valid proof of age for all performers
• They maintain all records required by 18 U.S.C. § 2257
• They will make such records available for inspection as required by law
• All content complies with applicable federal, state, and local laws

Exemptions

Content that does not depict actual sexually explicit conduct as defined under 18 U.S.C. § 2256(2)(A) may be exempt from these record-keeping requirements. However, Slaybox requires all creators to verify and maintain records of the age of all performers depicted in any content uploaded to the platform, regardless of whether such content depicts sexually explicit conduct.

Reporting Violations

If you believe any content on Slaybox violates 18 U.S.C. § 2257 or depicts individuals under the age of 18, please report it immediately to compliance@spinbox.app. We take all such reports seriously and will investigate promptly.
